As the Affirmative, you can prove First Amendment violation by punishing on not only action, but on thought. A hate crime is defined as one that targets a specific group, and by "selecting a target" they are being charged not only for their actions, but for what they were thinking while they acted. On the neg, this should be punished more severely because the crime is more heinous and effects an entire group. The crime is changed in the motivating factor.
