Can pornographic or sexual acts be considered "theater" or "art"?

Background and context

In recent years, in some main stream theaters, certain pornographic acts have been performed. This has been considered a part of the art form. Is this, however, appropriate?

In 2008, controversy in Japan developed around nude photography and its description as "art" in various galleries. This controversy rose to Japan's high courts, which ultimately ruled that such "art" was acceptable.
